外教聘请合同Contract
聘方姓名（以下称甲方）：Engager(partA)：
受聘方姓名（以下称乙方）：Employee(partB)：
聘请双方本着友好合作精神，自愿签订本合同并保证认真履行合同中约定的各项义务。
Thetwoparties,inaspiritoffriendlycooperation,agreetosignthiscontractandpledgetofufilconscientiouslyalltheobligationsstipulatedinit.
一、合同期自起至止。（法定节假日及寒暑假除外）

二、甲乙双方合作内容：Cooperationcontents:
甲方聘请乙方为教师进行英文授课。
EmployeeemployedbyengagerasateachertoteachEnglish.三、乙方工作时间TheworktimeofpartB1、根据学校的作息时间表，一般每周工作日为5天（节假日除外），如遇节假日学校调换课程时间则按学校要求安排授课。
Accordingtoschool’steachingschedule,teacherusuallywork5dayseachweek(exceptholidays).Iftheschoolchangethetimeinholidays,teachershouldteachaccordingtoschool’sarrangement.
2、遇甲方在合作学校有特殊活动时，乙方应该参加，如庆祝日、教研活动及一些重要的英语活动等，甲方对此给予乙方一定的交通补助，但不再支付其他费用。
IfpartAhavesomespecialactivitiesincooperationschool,partBshouldattend,forexample,celebrationday,teachingresearchactivitiesandsomeimportantenglishactivities,partAwillgivepartBsometransportfeeforthese,butnoextrapayment.
五、授课地点Teachingaddress
甲方根据乙方的实际情况，为乙方安排的课程在主城区内，如有其他变化，双方协商解决。
AccordingtopracticalsituationofpartB,partAwillarrangethecourseforpartBinMainTown.Ifhavesomechange,thetwopartiesshoulddiscusstosolve.
六、课时安排Classarrangement一般每周课时为课时亲自面授学生课（一课时的时间长短合作单位的课程表为准）。遇特殊情况，如学校课程调整等情况双方协商解决。
Usually,classesforaweek(thetimeofeachclassaccordingtoschoolschedule).Ifhavesomeurgentsituation,forexample,schoolscheduleadjusted,thetwopartiesshoulddiscusstosolve.
七、薪酬标准Salarycriterion
1、双方协商达成一致，按课时费的方式计算工资Thetwopartiesagreewitheachother。
2、双方协商达成一致，甲方不负责乙方寒、暑假的工作和生活，即甲方不支付工资给乙方，乙方可自行安排假期生活。但是甲方若为乙方安排了课程，乙方应首先满足甲方的要求，甲方按实际课时付费给乙方。

3、双方合作期间，甲方为乙方提供住房一套，乙方使用房屋所产生的费用由乙方自行负责，甲方每月第一周将当月房屋租赁费以现金方式支付给乙方。双方合作结束，甲方不再为乙方提供住房。八、其他事项Otherthings
1、乙方在合作期间的健康及医疗由乙方自行解决。

（1）如果乙方因患病并经医院证明确不能工作，可以向甲方提出请假，乙方在病假期间无工资。如果乙方连续7天请病假，甲方可以按照国家外专局合同有关规定中止与受聘方的合同。
IfpartBwassickandhavecertificatefromhospitaltocannotwork,partBcanapplyleave,butnosalaryintheseperiod.IfpartBapplyleave7dayscontinuous,partAcanterminatethecontractaccordingtothecontractissuedbystateadministrationofforeignexpertsaffairs.（2）如果乙方在工作时间内需请事假，须得到甲方的批准；如果乙方未向甲方提出请假，而旷工不上课，甲方有权在其旷工期间按双倍罚扣其工资
IfpartBapplyleaveinworktime,itmustbeconfirmedbypartA.IfpartBabsentfromclassandnoapplyleave,partAhaverighttodiscountthedoublesalary.
以上情况给合作学校造成损失的，乙方应积极给予弥补。Ifallsituationabovemakelosstothecooperationschool,partBshouldmakeupactive.九、机密secret
1、未经允许，双方均不可将工资数额及合同内容透露给第三方。Thetwopartiescannottellothersaboutsalaryandcontracts.2、未经甲方允许，乙方不可将授课学校情况透露给第三方。PartBcannottellothersaboutschoolsituation.
由此造成的损失，由造成损失方自行负责，另一方保留追加法律责任的权利。
Thelosswhoworkedhaveresponsibilityfortheloss,andotheroneretaintherighttosuperaddthelawliability.
十、合同的变更、解除和终止Contractchange,reliefandtermination
本合同自双方开始合作之日起生效，合同期满即自行终止。如一方需要解除合同，需提前20天通知另一方，否则视为违约。合同期满后，甲、乙双方聘用关系解除，乙方在华的一切事务自理。

I.PartyBwishestoengagetheserviceofPartyAGanzhouKingDoctorKindergartenofOxfordInternationalasaforeignEnglishteacher.Thetwoparties,inaspiritoffriendlycooperation,agreetosignthiscontractandpledgetofulfillconscientiouslyalltheobligationsstipulatedinit.
乙方自愿作为甲方外教在甲方从事教学服务工作。双方在友好合作的基础上签订本合同，并发誓遵守合同中所规定的各项条款。
II.Theperiodofservicewillbefromto.

乙方在甲方工作期间月工资为：￥6000元，以人民币形式支付。
V.PartyA"sObligations
甲方义务：
1.PartyAshallintroducetoPartyBthelaws,decreesandrelevantregulationsenactedbytheChinesegovernment,thePartyA"worksystemandregulationsconcerningadministrationofforeignexperts.
甲方有义务向乙方介绍甲方所在当地的相关法律、法规以及甲方工作机制、规程、规定以及与外国专家管理相关的规章制度。
2.PartyAshallconductdirection,supervisionandevaluationofPartyB"swork.甲方对乙方的工作负责指导、监督以及评价。3.PartyAshallprovidePartyBwithnecessaryworkingandlivingconditions.
甲方必须向乙方提供乙方工作和生活必需的条件和设施。4.PartyAshallprovidePartyBwithanassistantforworkingandlivingaffairs.
甲方应向乙方提供工作和生活联系人5.PartyAshallpayPartyB"ssalaryregularlybythemonth.
甲方应向乙方每月按期发放工资。VI.PartyB"sobligations
乙方义务：
1.PartyBshallobservethelaws,decreesandrelevantregulationsenactedbytheChinesegovernmentandshallnotinterfereinChina"sinternalaffairs.
乙方必须遵守中国的法律、法规和将关规定，不干涉中国内政。2.PartyBshallobservePartyA"sworksystemandregulationsconcerningadministrationofforeignexpertsandshallacceptPartyA"sarrangement,direction,supervisionandevaluationinregardtohis/herwork.WithoutPartyA"sconsent,PartyBshallnotrenderserviceelsewhereorholdconcurrentlyanypostunrelatedtotheworkagreedonwithPartyA.
乙方必需遵守甲方的工作制度及与外国专家管理相关的规定，并接受甲方在工作方面的安排、指导、监督和评价。未经甲方批准，乙方不得从事任何兼职工作。3.PartyBshallcompletethetasksagreedonscheduleandguaranteethequalityofwork.
乙方必须按照计划保质保量完成甲方委派的工作。
4.PartyBshallrespectChina"sreligiouspolicy,andshallnotconductreligiousactivitiesincompatiblewiththestatusofanexpert.
乙方必须遵守中国的宗教政策，不允许从事与外籍专家身份不符的宗教活动。5.PartyBshallrespecttheChinesepeople"smoralstandardsandcustoms.
乙方必须尊重中国人民的道德规范和风俗习惯。
6.IfPartyBhasanycontagiousorseriousdiseases,orifPartyBisfemaleinpregnancy,childbirthorbabynursingperiod,PartyBhasthedutytoinformPartyAbeforethecontractissignedsothatPartyAcanprovidespecialcaretoPartyB.Otherwise,PartyAwillnotbearanyrelatedresponsibilities.
乙方如有严重疾病或传染性疾病、或者女性有怀孕、待产、哺乳等情况，必须在签订合同之前，向甲方如实声明，否则造成后果由乙方承担全部责任。
VII.Revision,CancellationandTerminationoftheContract
合同的修改、取消和终止：
1.Bothpartiesshouldabidebythecontractandshouldrefrainfromrevising,canceling,orterminatingthecontractwithoutmutualconsent(exceptthatmentionedinVI,6).
双方必须严格遵守合同中所规定的内容。不经双方同意，不得擅自单方修改、取消或者终止合同。但本合同第VI条第六款所规定的情况除外。
2.Thecontractcanberevised,canceled,orterminatedwithmutualconsent.Beforebothpartieshavereachedanagreement,thecontractshouldbestrictlyobserved.
在双方同意的情况下，可以对合同进行修改、取消或者终止。但在此之前，必须严格遵守合同。
3.PartyAhastherighttocancelthecontractwithawrittennoticetoPartyBunderthefollowingconditions;
在以下情况下，甲方有权以书面形式通知乙方终止合同：
(1)PartyBdoesnotfulfillthecontractordoesnotfulfillthecontractobligationsaccordingtothetermsstipulated,andhasfailedtoamendafterPartyAhaspointeditout.乙方没有完成合同中所规定的内容，或者经甲方提醒仍没有履行合同中所规定的义务。
(2)Accordingtothedoctor"sdiagnosis,PartyBcannotresumenormalworkafteracontinued30daysickleave.
经医生诊断，乙方在连续30日病假后仍不能恢复正常工作。
4.PartyBhastherighttocancelthecontractwithawrittennoticetopartyAunderthefollowingconditions:
在以下情况下，乙方有权以书面形式通知甲方终止合同：
(1)PartyAhasnotprovidedPartyBwithnecessaryworkingandlivingconditionsasstipulatedinthecontract.
甲方没有按照规定为乙方提供工作和生活所需条件和设备。(2)PartyAhasnotpaidPartyBasscheduled.甲方没有按期向乙方发放劳务报酬。
VIII.BreachPenalty违约金
Wheneitherofthetwopartiesfailstofulfillthecontractorfailstofulfillthecontractobligationsaccordingtothetermsstipulated,thatis,breaksthecontract,itmustpayabreachpenaltyof￥50000RMB.任何一方不能按照合同中所规定内容执行，都将视为违约。违约方应承担￥50000元人民币的违约金。
IfPartyBaskstocancelthecontractduetoeventsbeyondcontrol,itshouldproducecertificationsbythedepartmentconcerned,obtainPartyA"sconsent,andpayitsownreturnexpenses;IfPartyBcancelsthecontractwithoutvalidreason,itshouldpayitsownreturnexpensesandpaybreachpenaltytoPartyA.IfPartyAaskstocancelthecontractduetoeventsbeyondcontrol,withtheconsentofPartyB,itshouldpayPartyB"sreturnexpenses;ifPartyAcancelsthecontractwithoutvalidreason,itshouldpayPartyB"sreturnexpensesandpayabreachpenaltytoPartyB.如果因不可抗原因乙方请求终止合同，须出示有关部门开具的证明材料，经甲方批准，自费返程路费。如果没有正当理由乙方擅自终止合同，乙方应自费返程路费，并承担违约责任。如果甲方因不可抗原因结束合同，经乙方同意后，应由甲方负责提供乙方返程路费。如甲方没有正当理由擅自终止合同，应负责向乙方提供返程路费，并承担违约责任。
IX.Theappendixofthiscontractisaninseparablepartofthecontractandhasequaleffect
本合同附件与合同正文具有同等法律效力。
X.Thiscontracttakeseffectonthedatesignedbybothpartiesandwillautomatically
expirewhenthecontractends.Ifeitherofthetwopartiesasksforanewcontract,itshouldforwarditsrequesttoanotherparty2weekspriortotheexpirationofthecontract,andsignthenewcontractwithmutualconsent.PartyBshallbearallexpensesincurredwhenstayingonafterthecontractexpires.本合同自签订之日起生效，到合同期满自然终止。如其中任何一方有意延期，必须在合同期满2周前向对方提出，在双方同意下签订续约。合同期满后，乙方负责之后的所有滞留费用。XI.
Arbitration仲裁
Thetwopartiesshallconsultwitheachotherandmediateanydisputeswhichmayariseaboutthecontract.Ifallattemptsfail,thetwopartiescanappealtothelocalcourt.有关合同内容的含义，须双方及时互相沟通，及时处理其中可能存在的争议。如果经双方协商不能达成一致，可申请可向甲方所在地法院起诉。

外籍教师工作合同附件
ⅠRequiredworkassignmentoftheemployedparty受雇方工作任务：
1.Preparelessonswellpriortoteaching上课之前充分备课；2.ConductEnglishlessons课堂授课；
3.Assessstudents"work对学生学习进行考核
4.Takeanactivepartinstudents"extra-curriculumactivitiesoftheemployingParty积极参与学生课外活动。
ⅡThesalarytreatment工资待遇1.Directpayment直接支付
MonetarysalaryRMB/month.Thesalarywillbepaidonthe20thofeachmonthfromthedayofstartingworktotheexpirationofthecontract.Incasethetimeisshorterthanawholemonth,thepaymentshallbecountedbyday.Thedailywageshallbe1/30ofthemonthlysalary(thesamewithFebruary).每月以人民币形式支付工资。工资发放日期为合同签订后一直到合同期满之间每月20日。如果遇到不满一个月，按照天数计算工资，此时每日工资为月工资的1/30（二月份同）。
2.Indirectpayment.间接支付
1）Theemployingpartyagreestoprovidehousingconditionsandpayforthewaterandelectricity.雇用方提供住房条件和其水电费。
2）Theemployingpartyagreestopaytwiceforthedomestictravelingbonus.每学期两次的国内差旅交通费报销。
3)Theemployingpartyagreestoaffordholidaysbonus.节假日补贴。
ⅢWorkTime,RestandHolidays
工作时间、休息和假期
1.Theworktimeoftheemployedpartyshallbe40hourseveryweek(two-dayweekend)Iftheworktimecannotreachtheabove-mentionedamount,PartyAcanarrangeforPartyBsomeotherconcernedworkoractivities,otherwise,theemployedpartyshouldbepaidashavingreachedit.受雇方每周工作量为40小时（周末双休）。如果受雇方不能达到以上工作量，雇用方可根据需要安排受雇方其他工作作为补充。如果因雇用方原因致使受雇方不能达到要求所需工作量，则视为乙方已经满足工作量。
2.Iftheemployingpartyarrangesovertimeworkforthepartyemployed,itwillpaytheemployedpartyasalaryhigherthanthatnormalworktimeaccordingtolegalstandard.Theexactpaymentshouldbenegotiatedbetweenthetwoparties.如果雇用方安排受雇方从事工作量以外的工作，应付给雇用方额外工资。额外数额由双方协商。
3.TheemployedpartyisentitledtothefollowingpaidholidaysandfestivalsinChina:
NewYear"sDay,SpringFestival,MayDay,NationalDayandotherholidaysstipulatedbylawsandregulations.受雇方在中国享有以下假期和假日：元旦，春节，“五一”劳动节，国庆节以及法律、法规中所规定的其他节日。
ⅣSickleaveandprivateaffairsleave病假和个人事假
1.Certificatefromdoctorsforforeignersappointedbythehostinstitutionshouldbepresentedwhentheemployedpartyasksforsickleave.受雇方请病假应持有雇用方指定的医疗机构开具的医疗证明。
2.Privateaffairsleaveoftheemployedpartyshallbeapprovedbytheemployingparty.Theemployingpartywilldeductthesalarybyday.Inthecontractterm,theprivateaffairsleavesshouldnotexceed10days.Thecontinuousprivateaffairsleaveshallbenomorethan3days,andtwodays"salarywillbedeductedforeachdaythereafter.雇用方应准许受雇方请个人事假。期间工资按照天数扣除。在合同期内不超过10天。单次事假原则上不能超过3天，超过3天后每天扣除2天的工资。
3.Incaseofabsencefromworkwithouttheemployingparty’spermission,3days"salarywillbedeductedforeachdayabsent.Forseriouscircumstances,theemployingpartyhastherighttoterminatethecontractandinvestigatetheliabilityoftheemployedpartyforviolationofthecontract.不经雇用方批准擅自离职，每旷工一天扣除3天的工资。在特殊情况下，雇用方有权对违反规则的受雇方终止合同并调查受雇方的可靠性。
ⅤConfirmationandchangeofeverytermoftheappendixofthestandardcontractmustbestipulatedinwrittenformthroughnegotiationbetweenthetwoparties.Anyoralagreementwillberegardedasinvalid.
本合同附件的确认和修改须经过双方协商后以书面形式写明。任何口头规定都视为无效。Thisappendixhasequalvalidityofthestandardcontractandcomprisesanintegralpartofthecontract.
